Terms of Service

Welcome to Promotiv Products Inc. (“we,” “our,” or “the Company”). These Terms of Service (“TOS”) govern your purchase of custom apparel, promotional products, and printing services (“Products and Services”) from us. By placing an order, you (“the Customer”) agree to these terms.


1. Orders and Deposits

  • Deposit Requirement: All orders require a deposit. The deposit amount is calculated per job and provided at the time of quoting.

  • Non-Refundable Deposit: Once the order is confirmed and the final proof is approved, the deposit becomes non-refundable.


2. Proofing Process

  • Customer Review: You are responsible for reviewing and approving the final proof before production begins.

  • Final Sale Upon Approval: By approving the final proof, you confirm that all details—such as design, text, colors, spelling, and layout—are correct. Any errors or issues present in the approved proof are accepted by you, and the sale becomes final.

  • Our Responsibility: We are not liable for errors in the finished product that match the approved proof.


3. Payment Terms

  • Balance Due: The remaining balance is due upon completion of the order, before delivery or pickup.

  • Grace Period: After order completion, there will be a grace period of 14 calendar days prior to the application of late payment fees.

  • Late Fees: A late fee of 0.5% per week will be applied to overdue balances, calculated from the due date specified in the invoice, not exceeding 2% per month. We may delay delivery until payment is received in full.


4. Intellectual Property

  • Your Responsibility: You confirm that you have the legal right to use any designs, logos, or trademarks you provide for customization.

  • Protection for Us: You agree to cover any costs or claims we face if someone challenges the use of your provided designs.


5. Delivery and Shipping

  • Shipping Costs: You are responsible for shipping and handling fees unless we agree otherwise.

  • Delivery Timing: We aim to meet estimated delivery dates but are not responsible for delays caused by shipping companies or other factors beyond our control.


6. Cancellations

  • Before Proof Approval: You may cancel an order before approving the final proof with no penalty.

  • After Proof Approval: Cancellations after proof approval forfeit the deposit. If production has started, additional fees may apply to cover our costs.


7. Unforeseen Events

We are not responsible for delays or failures to deliver due to events beyond our control, such as natural disasters, supply chain issues, or government actions.


8. Warranties and Liability

  • Our Promise: We guarantee that the finished products will match the approved proof.

  • Limits: Our liability is limited to the amount you paid for the order. We are not responsible for defects caused by your designs or instructions.


9. Privacy

We collect only the information needed to process your order and won’t share it with others, except as required (e.g., for shipping). Please refer to our Privacy Policy for further details.


10. Governing Law

These terms are governed by the laws of Ontario, Canada. Any disputes will be handled in Ontario courts.


11. Changes to These Terms

We may update these TOS at any time. Changes take effect when posted on our website or communicated to you. Continuing to order from us means you accept the updated terms.


12. Hours of Operation

Our office hours are Monday through Friday, 9:00 AM to 5:00 PM EST.

  1. Explore Our Product Categories

    • Visit the Apparel, Printing, or Promotional Products page to see our most commonly ordered items and their variants.

    • Note: We offer many more products beyond what’s listed! If you don’t see exactly what you’re looking for, don’t worry—we can likely still provide it.

  2. Submit Your Inquiry

    • At the bottom of each product category page, you’ll find a webform. Use this form to tell us about the product you’re interested in.

    • What to include:

      • Product name or description (even if it’s not listed on the website).

      • Quantity needed.

      • Customization details (e.g., design, colors, sizes, logos).

      • Any other relevant information (e.g., event date, special instructions).

    • The more details you provide, the better we can assist you!

  3. We’ll Respond via Email

    • After submitting the form, our sales team will review your inquiry and respond via email within 24-48 hours, aiming for the same business day.

    • During the follow-up, we’ll:

      • Discuss your order in detail.

      • Provide a custom quote.

      • Answer any questions you may have.

      • Confirm product availability, especially for items not listed on the website.

  4. Confirm Your Order

    • Once you’re happy with the details and quote, we’ll guide you through the next steps, including payment and proof approval (if applicable).

    • After your order is confirmed, we’ll provide an estimated delivery or pickup timeline.

  • Response Time: We aim to respond to all inquiries within the same business day, with a maximum window of 24-48 hours.

  • Custom Products: If you’re looking for something unique or not listed on our website, describe it in the webform. We’ll work with you to meet your needs.

  • Minimum Order Quantities: Some products may have minimum order requirements. We’ll let you know during the follow-up.

  • Payment Methods: We accept payment methods as outlined in our Terms of Service. Payment details will be provided once your order is confirmed.

  • Late Fees: A late fee of 0.5% per week will be applied to overdue balances, as outlined in our Terms of Service.

  • Proofing Process: For custom orders, we’ll provide a proof for your approval before production begins. Once approved, the sale is final, so please review carefully!
